（中央社記者陳俊華台北29日電）立法院內政委員會今天初審通過社會團體法草案，考量社會團體與職業團體及政治團體屬性不同，因此單獨立法，將社會團體設立由許可制改為登記制，管理面則予鬆綁採低度規範。

內政委員會下午邀請內政部次長花敬群列席，繼續逐條審查社會團體法草案。內政部提案指出，現行社會團體的組織及運作受人民團體法規範，人團法雖歷經多次修正，但內容仍以高度管制思維管理社會團體，與憲法保障人民結社自由的意旨不符。

內政部指出，考量蓬勃發展的社會團體為台灣社會的重要資產，政府應給予相關培力措施。修正草案中，除將社會團體的設立，由原許可制改為登記制外，在管理面則予以鬆綁，採低度規範，尊重團體自治，給予相關促進發展措施。

初審通過條文明定，登記為社會團體者，會員數應有20人以上，且登記名稱不得與其他團體相同，或有歧視性或仇恨性名稱。應登記事項有名稱、宗旨及任務、會址、章程、負責人姓名、理事與監事姓名及任期等；社會團體若因合併而消滅，或經決議解散者，應在30日內辦理解散登記。

社會團體每年至少召開一次會員大會，若涉及章程變更、不動產處分、團體合併或解散等事務，應經會員大會決議，且有過半數會員出席，且出席人數2/3以上同意行之。

為促進社會團體發展，社會團體得依有關稅法的規定減免稅捐；政府機關得運用公有空間，提供社會團體會務或業務發展使用；並編列年度預算辦理相關教育訓練、獎勵及其他培力措施。

社會團體若連續4年未召開會員大會，或有違反本法、章程或妨害公益情事，內政部應限期令其改善，屆期未改善者，廢止其登記、註銷登記書並公告之。

內政委員會召委、民進黨籍立委賴瑞隆會後受訪時表示，過去都是以人民團體法規範，但其中牽扯政治團體、社會團體與職業團體，所以新政府上任後切成3塊來處理，政治團體部分以政黨法規範，已經三讀通過。

賴瑞隆說，全台灣有5萬多個社會團體，希望能有更多鬆綁，讓社會團體蓬勃發展，此外也希望給社會團體更多支持，包括提供租稅優惠獎勵、政府提供場地，也有培養人才的措施，盼能符合國際趨勢，期待盡快完成三讀，讓人團法走入歷史。1061129
